Terms of Service

ScanVAT is operated by JIQ MEDIA LLC, a company registered in the United Arab Emirates.

§ 1 · Service definition

What ScanVAT is (and isn't)

ScanVAT is a data-extraction and compliance-preparation tool. The Service uses optical character recognition (OCR) and artificial intelligence to extract information from invoices and prepare Value Added Tax (VAT) filings and supporting documents.

ScanVAT is not: (a) an Accredited Service Provider (ASP) under Ministerial Decisions 243 and 244 of 2025; (b) a licensed tax agent registered with the UAE Federal Tax Authority (FTA); (c) a legal or tax advisory service. The Service does not submit, file, or transmit any document to the FTA on Your behalf.

Establishes that ScanVAT is a tool, not a regulated advisor. Critical for the ASP distinction under Ministerial Decisions 243 and 244 of 2025.

§ 2 · User responsibility

The user verifies and files — not ScanVAT

You are solely responsible for: (a) verifying the accuracy of all data extracted by the Service before using it in any tax filing or regulatory submission; (b) ensuring compliance with UAE VAT law, Corporate Tax law, and any other applicable laws; (c) maintaining original invoices and supporting documentation as required by the FTA; (d) submitting filings to the FTA through authorized channels, including any Accredited Service Provider where applicable.

You acknowledge that the Service may produce inaccurate or incomplete data, and that You must review every extracted value before relying on it. Your use of the Service does not transfer any tax or regulatory liability from You to ScanVAT or its operators.

Shifts responsibility for accuracy to the user. The law already puts responsibility on the taxpayer — this clause makes it contractual as well.

§ 3 · Limitation of liability

What we're liable for — and the cap

To the maximum extent permitted by UAE law, ScanVAT's total aggregate liability to You, whether in contract, tort (including negligence), or otherwise, arising out of or in connection with the Service, shall not exceed the total fees paid by You to ScanVAT in the twelve (12) months preceding the event giving rise to the claim.

ScanVAT shall not be liable for any: (a) fines, penalties, interest, or assessments levied by the FTA or any regulatory authority; (b) indirect, incidental, or consequential damages; (c) loss of profits, revenue, or business opportunity; (d) any damages arising from Your failure to verify data before submission.

Nothing in this clause limits liability that cannot lawfully be excluded under UAE law.

Caps exposure. The 'cannot lawfully be excluded' line is important — UAE law doesn't allow disclaimer of liability for gross negligence or fraud.

§ 4 · Accuracy disclaimer

OCR and AI are probabilistic

The Service relies on machine learning models to extract data from images and documents. These models are probabilistic and may produce errors, including but not limited to: misread digits, transposed values, incorrect dates, misidentified suppliers, and incorrect classification of goods or services.

ScanVAT displays confidence indicators on extracted data where possible. You should treat any extracted value as a draft requiring Your verification, regardless of the confidence indicator. High confidence does not guarantee accuracy.

Users can't later claim 'but the app said 94% confident!' Establishes that confidence scores are hints, not guarantees.

§ 5 · Data retention & deletion

UAE FTA 5-year retention, your right to delete

ScanVAT retains Your invoice data and audit logs for a minimum of five (5) years from the end of the tax period to which the data relates, as required by UAE Federal Decree-Law No. 28 of 2022, Article 78 (Tax Procedures) and FTA record-keeping rules. Records relating to real estate may be retained for a longer period where the law so requires.

You may request deletion of Your account and associated data at any time. ScanVAT will honor such requests within thirty (30) days, subject to the retention obligations above. Deletion requests submitted during an active tax dispute or audit may be deferred until the matter is resolved.

All data is stored in the United Arab Emirates (AWS me-central-1 region) and is not transferred outside the UAE without Your explicit consent.

Positions retention as a compliance feature, not a privacy cost. Also locks in the data residency commitment (AWS me-central-1).

Subscriptions & Payment

ScanVAT offers Free, Pro (AED 49/month), Business (AED 149/month), and Accountant (AED 499/month) plans. Subscriptions are billed monthly via Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period. Prices are in AED inclusive of applicable taxes.

Governing Law

These terms are governed by the laws of the United Arab Emirates. Any disputes are subject to the exclusive jurisdiction of the courts of Dubai, UAE.
